Terms of Service
Welcome to The Shot List. These Terms of Service ("Terms") govern your use of theshotlist.com and related services (the "Platform"), operated by Artist House, LLC ("The Shot List," "we," "us"). By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
The Shot List is an introduction platform. We help musicians and their teams ("Artists") discover and contact videographers, photographers, makeup artists, and stylists ("Creators"). We are not a party to any booking, engagement, contract, or payment between Artists and Creators. We do not employ Creators, we do not process payment for their work, we take no commission on their work, and we make no promises about the outcome of any engagement. All bookings, negotiations, payments, deliverables, and disputes are solely between the Artist and the Creator involved.
We review Creator profiles before they appear in search results, and the AUSTERE Vetted badge reflects a subjective editorial review of a portfolio. Neither the review nor the badge is a background check, a guarantee of quality, reliability, or safety, or an endorsement of any specific engagement. You are responsible for your own diligence before hiring or working with anyone you meet through the Platform.
You must be at least 18 years old to use the Platform. A parent, legal guardian, or manager who is at least 18 may hold and operate an account on behalf of an artist under 18, and is fully responsible for all activity on it. You agree to provide accurate information, keep your login credentials secure, and accept responsibility for activity under your account. One person per account; agents and managers may operate an account on an Artist's behalf with that Artist's authority.
By uploading content to a profile (images, video, text, credits), you grant The Shot List a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and reasonably promote that content on and in connection with the Platform (including search results, shared lists, social previews, and marketing of the Platform). You keep all ownership of your work. This license ends for specific content when you delete it, except for cached or archival copies retained for a commercially reasonable period and content already shared by other users (for example, in a saved list preview).
You represent that you own or have the necessary rights to everything you upload, including rights to depict any recognizable people, and that your credits are truthful. Uploading work that is not yours, or claiming credits you did not earn, is grounds for removal.
We sometimes create draft profiles for working creatives from professional information (name, craft, city, public links) before they join, visible only through a private claim link. A draft becomes a live profile only if its subject claims and completes it. Anyone may have their draft permanently deleted at any time using the removal link in the claim email or by writing to legal@theshotlist.com. Unclaimed drafts are automatically deleted after 90 days.
We may approve, decline, suspend, or remove any profile, content, or account at our discretion, including for quality, accuracy, safety, or violation of these Terms. Suspended profiles are hidden from search; deletion is permanent. We may modify or discontinue features of the Platform at any time.
All payments to The Shot List are processed by Stripe. Prices are stated at purchase and may include applicable taxes.
Pro is a Creator subscription at $39 per month or $349 per year, renewing automatically until canceled. Cancellation takes effect at the end of the current billing period; features then revert to the free tier. No partial-period refunds.
AUSTERE Vetted is a $249 annual application fee covering an editorial review of a Creator's portfolio. If an application is declined, the fee is refunded in full, automatically. If approved, the badge remains active for one year and renews annually until canceled. The fee pays for the review; approval is never guaranteed.
Spotlight is a quarterly placement product: numbered slots at the top of specific category and city results pages, sold per slot per quarter, renewing automatically unless canceled before the term ends. Slot prices may change between terms with at least 14 days notice before renewal; prices never change mid-term. Canceling releases the slot at the end of the paid term. No partial-term refunds.
Promotional or complimentary access (including founding-creator benefits) is described at the time of grant, may carry an expiration date, and does not renew as a paid subscription without your action.
Artist accounts are free. Certain Artist perks are provided to active Artist House members; Artist House membership is a separate product with its own terms and billing, and is not sold by The Shot List.
You agree not to: use the Platform to harass, threaten, or defame anyone; send spam or bulk unsolicited messages through Platform messaging; misrepresent your identity, work, or credits; upload content that is unlawful, infringing, or sexually explicit; scrape, crawl, or bulk-extract Platform data; interfere with the Platform's operation or security; or use the Platform in connection with any unlawful purpose. Inquiry and messaging tools are for genuine hiring conversations.
Platform messaging exists so Artists and Creators can discuss real projects. Messages are stored on our systems and may be reviewed where necessary for safety, fraud prevention, legal compliance, or investigating reported abuse, as described in the Privacy Policy.
We respect intellectual property and expect users to do the same. If you believe content on the Platform infringes your copyright, send a notice compliant with 17 U.S.C. § 512 to our designated agent: DMCA Agent, Artist House, LLC, legal@theshotlist.com, 6333 E Mockingbird Lane, Ste 147 PMB 2187, Dallas, TX 75214, United States. [COUNSEL: confirm agent registration details match the U.S. Copyright Office filing.] We will respond to valid notices, including removing or disabling access to the identified material, and we terminate repeat infringers. Counter-notices may be sent to the same address.
The Platform is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or that any Creator or Artist will perform, pay, or behave as expected. We perform no background checks.
To the fullest extent permitted by law, The Shot List and its owners, employees, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the Platform or any engagement formed through it. Our total liability for any claim will not exceed the greater of $100 or the amounts you paid us in the twelve months before the claim arose.
You agree to indemnify and hold harmless The Shot List from claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Platform, your engagements with other users, or your violation of these Terms.
You may close your account at any time in settings. We may suspend or terminate accounts that violate these Terms. Sections that by their nature survive termination (including 3, 9 through 12, and 14) survive.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Before filing any claim, you agree to first contact us at legal@theshotlist.com with a written description of the dispute and give us 30 days to resolve it informally. Except for disputes that qualify for small claims court, or claims for injunctive relief regarding intellectual property or unauthorized platform access, any dispute arising from these Terms or the Platform will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in Dallas County, Texas or conducted remotely at your election. You and The Shot List each waive the right to a jury trial and the right to participate in a class action, class arbitration, or representative proceeding. You may opt out of this arbitration agreement by emailing legal@theshotlist.com within 30 days of first accepting these Terms, stating your name and account email; opting out does not affect any other provision. If the class-action waiver is found unenforceable as to a particular claim, that claim proceeds in the courts of Dallas County, Texas, and this section otherwise remains in effect.
We may update these Terms. For material changes we will give notice on the Platform or by email, and continued use after the effective date constitutes acceptance.
